Explanation: 52nd Constitutional Amendment Act, 1985 provided for provisions related to antidefection in India. It laid down the process by which legislators may be disqualified on grounds of defection. All decisions related to disqualification for defection are being taken by the presiding officer of the concerned house, whose decision is final. However, the decision of presiding officer is subject to Judicial Review.
